Terms of Purchase

1. Introduction

These Terms and Conditions govern your use of Nibble & Peck (“we”, “us”, “our”, “the Website”), located at 8 Bowmount Park, Newtownards, County Down, BT23 8SS. By using our Website, you accept these Terms and Conditions in full. If you disagree with these Terms and Conditions or any part of them, you must not use our Website.

2. Purchases, Ordering & Payment

2.1. All purchases made on the Website are subject to availability.
2.2. We reserve the right to refuse or cancel any order for any reason at any time.
2.3. Payment must be made at the time of ordering unless otherwise agreed in writing.
2.4. Upon cancellation of an order by you, we reserve the right to withhold deposit paid or 25% of the full payment that has already been made to cover the loss of trade and potential purchases made in the interest of that order.

3. Collection & Delivery

3.1. Delivery rates are calculated upon ordering based on your postcode and will automatically display upon entering your delivery information.
3.2 We currently cover the following postcodes – BT23 4, BT23 7, BT23 8(£2), BT19, BT20, BT23 5(£3), BT23 6, BT18, BT21, BT16(£4), BT23 6, BT22, BT5, BT4(£5), BT8, BT7, BT6,

3.3. We hand deliver every item; therefore, we can only offer estimated times for delivery.
3.4. If there is no response at the address, we will attempt to contact the customer and leave the box in a safe place. If unable to do so, we may place it in a plastic carrier bag and leave it on the doorstep. If unattended for 15 minutes, the goods will require collection or redelivery for a fee.

4. Product Information & Quality Assurance

4.1. We endeavor to provide accurate allergen information for each product and comply with all applicable health, hygiene, and quality standards.
4.2. We are not required to follow Natasha’s Law 2021 as we make all items fresh to order and they are not physically displayed for sale to the public.
4.3. Any complaints should be made within the recommended use-by date of 3 days from delivery/collection and will be dealt with as per our Returns Policy.

5. Deposit Payment

5.1. Deposit payments are 25% of the order total, including shipping, and can be made by contacting us directly via our social media platforms.
5.2. Deposit payments are refundable at our discretion, and proof may be required for events beyond the control of the consumer.

6. Returns & Complaints

6.1. Our aim is to provide the best quality product and service. Any complaints will be recorded and dealt with as per our Returns Policy available on the Website.
6.2. We will accept full responsibility if any mistakes were our fault and we will correct them as soon as possible.
6.3. Due to our products being made to order, we are not obligated to provide a full refund. We must be allowed to make the mistake right therefore an exchange of the product or a voucher for the value will be provided in most circumstances.

7.1. All content on the Website is our property and is protected by copyright laws.
7.2. You may not use, reproduce, or distribute any content from the Website without our express written permission.

8. Governing Law & Statutory Rights

8.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom.
8.2. Nothing in these Terms and Conditions affects your statutory rights under the Consumer Rights Act 2015.

9. Termination of Service

9.1. We reserve the right to terminate our service due to unforeseen circumstances, including but not limited to ill health, pandemic situations, or other events beyond our control.
9.2. For termination of service a full refund will be provided.
9.3. In the event of termination or suspension of service, we will make every effort to notify customers promptly and will discuss suitable alternatives or refunds where applicable.
9.4. We are not liable for any loss, damage, or inconvenience arising from the termination or suspension of services.

Gift Vouchers

1. Validity Period

1.1. The gift voucher has a validity period of 12 months (360 days) from the date of purchase.
1.2. After the validity period the gift voucher will automatically deactivate.

2. Redemption

2.1. The gift voucher may be redeemed for any product available online by Nibble & Peck.
2.2. Products purchased using a gift voucher are redeemed only against the price at the time of redemption.
2.3. The gift voucher can be redeemed alongside other coupons.
2.4. If you do not spend the full balance of the gift voucher, you will receive an email detailing your remaining balance, which can be used at another date.

3. Refunds/Transfers

3.1. The gift voucher cannot be returned or exchanged for cash or credit.
3.2. The gift voucher can only be used by the recipient. Reassignment to another party is strictly at our discretion.
